COMPLAINT IN DIVORCE
AND NOW, comes the Plaintiff, Charles E. Warren, by and through his attorneys, Sebald, Hackwelder, & Knox, and files the following Complaint in Divorce, stating in support thereof the following:
1. Plaintiff Charles Warren is an adult individual with a residence located in Erie County, Pennsylvania.
2. Upon information and belief Defendant, Kimberly Kaye Warren is, residing at 123 Crestmont Drive, Gaffney, South Carolina, 29340.
3. Plaintiff and Defendant have been bona fide residents of the Commonwealth of Pennsylvania for at least six (6) months immediately preceding the filing of this Complaint.
4. Plaintiff and Defendant were married December 14, 1978.
5. The parties were separated as of 1979.
6. Neither party has ever applied in this or any other Court for divorce from the other party to this action or for an annulment of their marriage.
7. Defendant has been advised of the availability of counseling and of the right to request the Court to require the parties to participate in counseling.
8. Plaintiff avers that there are no children under the age of eighteen (18) born of marriage.
COUNT I
(Warren v. Warren-Divorce Pursuant to §3301(c) or (d) of the Divorce Code)
9. Paragraphs one through seven are hereby incorporated herein by reference as if fully set forth below.
10. Plaintiff is entitled to a divorce from the Defendant on the following grounds:
a. Plaintiff avers that the marriage between the parties is irretrievably broken and believes that Defendant will consent to the entry of a divorce decree under 23 Pa.C.S.A. § 3301(c), after ninety (90) days of the filing and service of the within Complaint.
b. Plaintiff avers that the marriage between the parties is irretrievably broken within the meaning of 23 Pa.C.S.A. § 3301(d) of the Divorce Code, and the parties will have lived separate and apart for a period of at least one (1) year at the time of hearing of this matter and/or at the time that Plaintiff will file an affidavit under 23 Pa.C.S.A. § 3301(d).
WHEREFORE, Plaintiff, Charles Warren requests this Honorable Court to issue a Decree in Divorce divorcing Plaintiff and Defendant from the bonds of marriage and distribute the marital property of the parties.
