Plaintiff is the owner of four (4) parcels of real property located in the Township of Summit, County of Erie, Commonwealth of Pennsylvania. Parcel No. (40) 12-46-1.01 is known as 100 Pennbriar Drive; Parcel (40) 12-46-1.03 is known as 0 Schultz Road; Parcel No. (40) 12-46-1.04 is known as 7825 Schultz Road; and Parcel (40) 12-46-1.07 is known as 0 Schultz Road. Plaintiffs are seeking an Order declaring that: (1) the 1987 Mortgage recorded at Record Book 33, Page 1302 is satisfied and discharged; (2) the 1987 Mortgagees or, alternatively, the Erie County Recorder of Deeds must deliver or record any document necessary to have the 1987 Mortgage marked satisfied and discharged; (3) the 1998 Mortgage recorded at Record Book 589, Page 77 is satisfied and discharged; and (4) Leasing Capital or, alternatively, the Erie County Recorder of Deeds must deliver or record any document necessary to have the 1998 Mortgage marked satisfied and discharged.
Plaintiff has filed this action to quiet title to the property and seeks to bar the defendants from ever asserting any right, title, interest, lien or claim against the property.
