TO THE DEFENDANT and all of its successors and assigns:
Take Notice that Plaintiffs have filed a Complaint alleging that Plaintiffs are the fee simple owners of certain premises situate in the City of Erie, Erie County, Pennsylvania described as follows:
Commonly known as 1061 West 10th Street, City of Erie, PA.
Erie Co. Index No.: (16) 30-51-224, conveyed to Plaintiffs by Deed from Mary Jane Deck to Plaintiffs dated January 19, 2000 and recorded January 19, 2000 in the Office of the Recorder of Deeds for Erie County.
That Plaintiffs and their Grantor have owned the property for over fifty-four (54) years. That the Plaintiffs’ Grantor executed a Mortgage in favor of Defendant, First Investment Company dated March 2, 1971 and recorded March 3, 1971 at Erie County Record Book 889, P. 249. Said Mortgage has not been marked “satisfied” by the Defendant, despite the owners having no contact with the Defendant, First Investment Company in over twenty-four years. The Plaintiffs’ Grantor paid the loan in full by April 2001, per the terms of the Mortgage. It is presumed that the Defendant’s Mortgage was paid off twenty-four (24) years ago.
The Plaintiffs claim that the interests of the Defendants should be barred forever. Plaintiffs request that the Court enter an Order decreeing that all of the right, title and interest in the subject premises is vested in the Plaintiffs and the said Mortgage should be marked “satisfied.”
THE COURT HAS DIRECTED SERVICE UPON THE DEFENDANT, ITS SUCCESSORS AND ASSIGNS BY PUBLICATION. A DEFAULT JUDGMENT WILL BE ENTERED AGAINST THE DEFENDANT, ITS HEIRS, SUCCESSORS AND ASSIGNS, SHOULD THERE BE NO ANSWER FILED OR APPEARANCE ENTERED ON THEIR BEHALF.
