ALL THAT CERTAIN piece or parcel of land situate in the Village of Beaverdam, Township of Wayne, County of Erie and Commonwealth of Pennsylvania, bounded and described as follows:
BEGINNING at a post in the middle of the public road running from Beaverdam Corners to Wattsburg west of the northwest corner of a lot formerly owned by William Hodge;
THENCE easterly along the north line of said Hodge lot and lot now formerly of Rebecca Smith, thirty-one and one-half (31-l/2) perches to a post in the west line of land now or formerly of Henry F. Ross;
THENCE north fourteen degrees west (N 14 degrees W) along the west line of said Ross’ land six (6) perches to a post, the southeast corner of land now or formerly of Orson W. Follett, formerly William J. Follett’s land;
THENCE westerly along the south line of said Follett’s land and the south line of the United Brethen Parsonage lot, thirty-one and one-half (3l-1/2) perches to the center of the public road;
THENCE southerly along the center of the public road six (6) perches to the place of beginning, containing about one hundred eighty-nine (189) perches of land, be the same more or less.
EXCEPTING AND RESERVING THEREFROM all that certain parcel of land conveyed to Shawn L. Smith and Joanne M. Smith, husband and wife, by deed recorded October 27, 1999 in Erie County Record Book 670 at page 1194.
EXCEPTING AND RESERVING THEREFROM all that certain parcel of land conveyed to Kenneth W. Vamos by deed recorded October 27, 1999 in Erie County Record Book 670 at page 1188.
EXCEPTING AND RESERVING THEREFROM all that certain piece or parcel of land conveyed to Jerry B. Miller and Donna A. Miller, husband and wife, by deed recorded October 27, 1999 in Erie County Record Book 670 at page 1182.
The above-described land is further identified as the residue lands of Helen A. Pugh as set forth on the Subdivision of land for Helen A. Pugh recorded August 4, 1999 in Erie County Map Book 1999-242.
BEING that same premises conveyed to Shawn P. Gregory, be deed dated April 12, 2013 and recorded in Erie County Recorder’s Office on April 16, 2013 as Instrument Number 2013-008997.
Being the same parcel of land conveyed to Jerry B. Miller and Donna A. Miller, be deed from Shawn P. Gregory, dated September 16, 2021 and recorder in Erie County Record Book as Instrument # 2021-024790, is valid and indefeasible as against all rights and claims whatsoever and that the Defendants, Donald L. Middleton and Jeffrey L. Middleton and Kerrie M. Middletown, husband and wife, their heirs, executors, successors, administrators, beneficiaries, assigns, transferees, and all others claiming from, by and under through them, are barred inconsistent with the claims of the Plaintiff, as set forth in its Action to Quiet Title, and further that the Defendants are enjoined from having any claim to title or interest in the property described above, unless the said Defendants being an Action of Ejectment within thirty (30) days after the entry of this Decree.
The Court has ordered that Notice of the action may be given by Publication so that title to the property may be adjudicated. The Complaint requests the Court to decree that title to the property is free and clear of any claim or interest of said Defendants, their heirs and assigns, and anyone claiming by, through or under them and that the said Defendants be barred by asserting any right, title and interest in and to the property inconsistent with the interest and claim of the Plaintiffs unless an action in ejectment is brought within thirty (30) days of the Court’s Order.
