TO: Donald F. Lilley and unknown heirs of John Francis Lilley and unknown heirs of Errol J. Lilley, Defendants
TAKE NOTICE that the named Plaintiff has filed a Complaint in Action to Quiet Title on October 2, 2024 at AD 2024-637 averring the following:
1. The Plaintiff, Lucas Anton Stinson Hayas is an adult individual residing at 5550 Stonewall Place, Apt. 22, Boulder, Colorado, 80303.
2. Defendants Donald F. Lilley and Sharon Ann Lilley are the surviving children of John Francis Lilley and Vivian L. Lilley, whom are both deceased.
3. The remaining Defendants are unknown heirs of John Francis Lilley and Errol J. Lilley, who was John Francis Lilley’s father.
4. The property in question is all that certain piece or parcel of land situated in Sparta Township, Crawford County, Pennsylvania, and bounded and described as follows:
BEGINNING at the southwest corner of land formerly owned by Mallery Manville; thence east two hundred and twelve perches (E. 212 per.) to a post; thence south sixty-nine and five-tenths of a perch (S. 69.5 per.) to a post; thence west two hundred and twelve perches (W. 212 per.) to a post; thence north sixty-nine and five-tenths perches (N. 69.5 per.) to the place of beginning. Containing eighty-eight acres (88 A.) and one hundred and twenty-seven perches (127 per.) of land, be the same, more or less, with the allowance of six percent for roads and so forth. Known as Tax Parcel #4902-024.
ALSO, the right of a suitable road where necessary to cross the property of W. F. Crosby on land conveyed to said W. F. Crosby by Julia E. Lilley by deed dated November 18, 1929, in which this right-of-way was reserved, and deeded to C. J. Lilley January 31, 1931, recorded in Deed Book 285, Page 207. This also conveys jointly with C. J. Lilley and W. F. Crosby, the right-of-way of a strip of land for a road thirty-three feet (33 ft.) wide, running from said W. F. ‘Crosby’s land, to the Spartansburg and Corry road, at a point on said road nearly opposite to the house (or lot) formerly of John Yould (or Gould). Said right-of-way of thirty-three feet (33 ft.) being taken from the land formerly of F. Squire and running along the line of land of the heirs of Eligha (Elijah) Groom estate.
Bearing Crawford County Assessment No. 4902-024 (the “Subject Property”).
5. The Plaintiff acquired the Subject Property by virtue of a deed dated April 21, 2023 from John E. Lilley, and being filed in the Crawford County Recorder’s Office at Instrument No. 202304609. A copy of said deed to the Subject Property is attached hereto as Exhibit “A”.
6. John E. Lilley acquired title to the Subject Property by virtue of a deed dated October 24, 2017 from Donald F. Lilley and Ellen M. Lilley, husband and wife, and being filed in the Crawford County Recorder’s Office at Instrument No. 201712474.
7. Donald F. Lilley and Ellen M. Lilley, husband and wife, acquired title to the Subject Property by virtue of a deed dated August 16, 1988 from Vivian L. Lilley, widow, and being filed in the Crawford County Recorder’s Office in Record Book 46, Page 816.
8. John Francis Lilley and Vivian L. Lilley, husband and wife, acquired title to the Subject Property by virtue of a deed dated July 3, 1975 from John Francis Lilley and being filed in the Crawford County Recorder’s Office in Record Book 492, page 913.
9. It is unknown how John Francis Lilley and Vivian L. Lilley, husband and wife, obtained title to the Subject Property because there is no deed on record of this conveyance, therefore creating a defect in the chain of title.
10. Prior to John Francis Lilley and Vivian L. Lilley, husband and wife, obtaining title to the Subject Property, Errol J. Lilley, father of John Francis Lilley, obtained title to the Subject Property by virtue of a deed dated April 22, 1941 from J.W. Lilley, single, and being filed in the Crawford County Recorder’s Office in Record Book 302, Page 552.
11. Prior to J.W. Lilley, single, obtained title to the Subject Property by virtue of a deed dated April 25, 1941 from C.J. Lilley, single, and being filed in the Crawford County Recorder’s Office in Record Book 302, Page 551.
12. John Francis Lilley died on November 17, 1983 and Vivian L. Lilley died on June 17, 2003.
13. Erroll J. Lilley died on December 12, 1948.
14. Due to the missing deed conveying John Francis Lilley and Vivian L. Lilley interests in the Subject Property, an inherent title defect burdens the Subject Property.
15. This Quiet Title Action is necessary for the purpose of extinguishing any rights claimed by the Defendants.
16. The Plaintiff executed an Agreement of Sale for the Subject Property on January 2, 2024. The sale has not closed due to this title defect.
17. This Quiet Title Action will enable the Plaintiff to hold and convey the Subject Property without a potential title defect.
WHEREFORE, the Plaintiff, Lucas Anton Stinson Hayas, hereby requests this Honorable Court:
1) To enter a decree declaring that any and all interest of John Francis Lilley, his Unknown heirs, and his successors and assigns, may have in the Subject Property be terminated;
2) To enter a decree declaring that any and all interest of Erroll J. Lilley, his Unknown heirs, and his successors and assigns, may have in the Subject Property be terminated
3) To enter a decree declaring that any and all interest of Donald F. Lilley and Sharon Ann Lilley, their successors and assigns, may have in the Subject Property be terminated
4) To enter a decree declaring that the Plaintiff is the sole and exclusive, fee simple owners of the Subject Property; and
To grant such other relief as this Court may deem just and equitable.
