TO: Oakland Beach Company and its successors and assigns, Defendant
TAKE NOTICE that the named Plaintiffs have filed a Complaint in Action to Quiet Title averring the following:
(1) That Charles J. McConville and Diane M. McConville are the leasehold owners of the following described premises, to-wit:
All that certain piece or parcel of land situate in Sadsbury Township, Crawford County, Pennsylvania, bounded and described as follows, to-wit:
BEGINNING at a point on the east shore of Conneaut Lake northerly one hundred (100) feet from the northeast corner of a ten (10) foot strip of land conveyed by D.L. McGuire, et ux, to Jennie M. Marshall recorded in Deed Book 278, Page 146; thence North 85o 18' East two hundred (200) feet to a point one hundred (100) feet from the northeast corner of lot now or formerly of Jennie M. Marshall; thence by land now or formerly of Oakland Beach Company North 5o 6' West fifty (50) feet; thence South 85o 18' West two hundred (200) feet, more or less, to the shore line of Conneaut Lake; thence by Conneaut Lake south fifty (50) feet to the place of beginning, on which is erected and situate a two story cottage.
Said property is further identified as a Crawford County Parcel ID #4403-040-21 and known as 11797 Pine Ridge Lane, Conneaut Lake, PA 16316 (the “Subject Property”).
(2) That any and all interest of the Oakland Beach Company, or its successors or assigns, have in the Subject Property is terminated, void, and of no legal affect;
(3) That the Plaintiffs are the sole and exclusive, fee simple owners of the Subject Property not subject to any claim or interest by the Oakland Beach Company or any successor or assigns;
(4) Plaintiffs aver that, after considerable due diligence, the present whereabouts or existence of the above-named Defendants, or successor and assigns, is unknown to it; and
(5) Plaintiffs have requested the Court to enter a decree that title to the Subject Property is vested in the Plaintiffs, solely, free from any claim of the Defendant, or its successors or assigns and to enjoin the Defendant, or its successors and assigns, from asserting any interest to the Subject Property or from impeaching, denying or in any way attacking Plaintiffs’ exclusive title to the Subject Property.
TAKE NOTICE THAT THE COURT HAS ORDERED THAT THE AFOREMENTIONED COMPLAINT BE SERVED BY PUBLICATION.
