NOTICE OF SALE OF REAL PROPERTY
NOTICE IS HEREBY GIVEN THAT Ronda J. Winnecour, Chapter 12 Trustee of the Estate of BERNARD RALPH WAGNER, has filed a MOTION TO SELL REAL PROPERTY FREE AND CLEAR OF LIENS PURSUANT TO 11 U.S.C. § 363, which property is described generally as follows:
Three (3) parcels of real property that contain, in total, about 97.76 acres, designed and broken out as follows: Crawford County Tax Parcel Nos. 1801-022-5 (35.33 acres more or less), 2407-029 (62 acres more or less), and 2407-030 (1 acre more or less). The 3 parcels comprise what can be described as a “lifestyle farm” located next to Cochranton High School, on the south side of North Franklin Street, Cochranton Borough & East Fairfield Township, in Crawford County, Pennsylvania. The property includes a dwelling (having a physical address of 179 North Franklin Street, Cochranton, PA 16314), shop, bank barn, and pole barn. The vacant parts of the parcels consist mostly of cropland and brushy/wooded areas. The subject property is titled in the joint names of Bernard Ralph Wagner and Rowena V. Wagner, his wife by Deed dated March 9, 2006, and filed at Instrument Number 200600002620 or Book 810, Page 349, in the Recorder of Deeds, Crawford County, Pennsylvania.
The Motion is brought on the offer of Ernst Farms, LLC, to purchase the property for $330,000.00, according to the terms set forth in the Motion for Sale. Please note that the offer includes a side deal between offeror and the Debtor for a leaseback of the residence, barn, and several acres. COMPETITIVE BIDS WILL NOT BE BOUND TO THE LEASEBACK ARRANGEMENT.
