JAMES R. SCHMELTZ, deceased and his known heirs CAROLINE RICKERT AND JAMES SCHMELTZ and their heirs, successors and assigns and unknown heirs of JAMES R. SCHMELTZ, deceased and his heirs, successors and assigns, Defendants
TAKE NOTICE that the Plaintiff above-named has filed a Complaint in an Action to Quiet Title, averring that they are the owners of the following described parcel of land in North Shenango Township, Crawford County, Pennsylvania, which is bounded and described as follows:
Being known as lots 470, 471 as shown on Tuttle Plan of lots recorded at Plan Book 3 page 62, Crawford County Court House, Meadville, PA recorded April 6, 1954.
Being and intending to be Tax Parcel No. 4602-1-471R.
That Plaintiff Pratt Properties, LLC acquired the aforementioned property herein, by Judicial Tax Sale deed of dated 6-23-16 and recorded 6-30-16 in Record Book 1252-540 at Crawford County Recorder of Deeds office. Said Judicial Sale held on June 3, 2016 (AD 2015-744 aka 2015D Petition), pursuant to the authority given in the Act of 1947, P.L. 1368 (Real Estate Tax Sale Law), as amended, 72 P.S. 5860.612
James R. Schmeltz, deceased, was named owner in said Judicial Petition and James Schmeltz was named as one of his heirs.
There appears to exist a cloud on the title to the aforesaid parcel of land because title insurance policy providers are contending one exists due to the heirs of JAMES R. SCHMELTZ, being ineffectively served via publication after attempted out of state service was returned unclaimed by said heirs in the due course of said Judicial Sale at AD 2015-744.
WHEREFORE, the Plaintiff respectfully pray that your Honorable Court decree that title to the here and above described property is in the Plaintiff as their interest appears of record; that the Plaintiff shall be allowed to enjoy said property in peace and that the Defendants, their heirs, successors or assigns, be perpetually and forever enjoined from setting up any title to the said premises, from impeaching, denying or in any way attacking the Plaintiff title to the said parcel of land, from issuing or maintaining any action of ejectment of said for said premises, and from encumbering, mortgaging, or conveying the same, or any part thereof.
AND THEY WILL EVER PRAY.
WHEREUPON, the court ordered that notice of said facts be served by publication once in the Crawford County Legal Journal and the Meadville Tribune Newspaper and that the Defendants, their heirs, successors or assigns, and any and all other persons having any interest or apparent interest in the parcel aforedescribed or in these proceeding shall file an Answer to said Complaint within twenty (20) days after the last publication of this Notice.
